How and why do trout think? How do they decide where to eat and which food to eat? Why do they refuse to behave as predicted, stumping anglers by rejecting a larger fly for a smaller one or not responding at all to anything in an angler’s box? How do trout know to bolt to one particular covered area after being hooked or flushed? Why can trout smell better than humans but not remember as well? Citing the most recent scientific findings in a readily understandable form, Thomas C. Grubb, Jr. addresses these questions and more in The Mind of the Trout. It is the first book to bring together many varied concepts of cognitive ecology as applied to trout and their salmonid relatives: char, salmon, grayling, and whitefish.

Good piece of work though overly theorical and without much practical use as far as fishing goes. Nevertheless I liked the insights.

In the mid-twentieth century, far more evangelicals supported such “liberal” causes as peace, social justice, and environmental protection. Only gradually did the conservative evangelical faction win dominance, allying with the Republican Party of Ronald Reagan and, eventually, George W. Bush.
In Countercultural Conservatives Axel Schäfer traces the evolution of a diffuse and pluralistic movement into the political force of the New Christian Right. In forging its complex theological and political identity, evangelicalism did not simply reject the ideas of 1960s counterculture, Schäfer argues. For all their strict Biblicism and uncompromising morality, evangelicals absorbed and extended key aspects of the countercultural worldview.
Carefully examining evangelicalism’s internal dynamics, fissures, and coalitions, this book offers an intriguing reinterpretation of the most important development in American religion and politics since World War II.

Review

“A compelling history of evangelical politics from the early 1940s to the late 1990s. Schäfer’s ability to show how the Christian Right combines traditional moral convictions with modern consumerism, as well as his careful discussion of continuities from postwar suburbanization through post-1960s right-wing activism, makes his book a landmark contribution. This one is a gem.”—Mark A. Noll, author of God and Race in American Politics: A Short History

The Jewish Past Revisited: Reflections on Modern Jewish HistoriansFrom Yale University Press

In this new collection of essays, contemporary historians examine the ways earlier historians have framed, written, and "made" the Jewish past. Probing the ideology and methodology of their professional predecessors, American and Israeli historians offer new perspectives on some of the central figures of twentieth-century Jewish historiography, including Gershom Scholem, S. D. Goitein, Yitzhak Baer, Elias Bickerman, and Cecil Roth, as well as the Israeli "New Historians." Through their critical examinations of the construction of the Jewish past, the contributors to this volume develop important insights into current attitudes toward the dominant canons and ideals of historical scholarship and the future of historiography. They shine new light on the formation of a historical worldview and the "making" of history.

Selected Letters of Rebecca West, by Rebecca West

From the time that George Bernard Shaw remarked that Rebecca West could handle a pen as brilliantly as ever I could and much more savagely, West's writings and her politics have elicited strong reactions. This collection of her letters the first ever published has been culled from the estimated ten thousand she wrote during her long life. The more than two hundred selected letters follow this spirited author, critic, and journalist from her first feminist campaign for women's suffrage when she was a teenager through her reassessments of the twentieth century written in 1982, in her ninetieth year. The letters, which are presented in full, include correspondence with West's famous lover H.G. Wells and with Shaw, Virginia Woolf, Emma Goldman, Noel Coward, among many others; they offer pronouncements on such contemporary authors as Norman Mailer, Nadine Gordimer, and Arthur Schlesinger, Jr.; and provide new insights into her battles against misogyny, fascism, and communism. West deliberately fashions her own biography through this intensely personal correspondence, challenging rival accounts of her groundbreaking professional career, her frustrating love life, and her tormented fami

Amazon.com Review
"I have many anecdotes to tell you--my life is a series of anecdotes," Rebecca West exclaimed in 1925, "all of which seem to me in the worst possible taste!" This teasing valediction is only one of the thousandfold pleasures within Selected Letters of Rebecca West. Bonnie Kime Scott has chosen over 200 sparkling, combative, and committed pieces of correspondence, and the result makes one wonder how she could bear to leave the other 9,800 or so out. West (1892-1983) gave us some of the 20th century's greatest fiction and nonfiction, and her letters are equally artful. Scholars will be drawn in by her historical acuity, while others will seize on West's sharp reportage and (of lesser import but equal joy) gossip. This "novelist-newshen" never seems to have been off duty, and bon mots abound. She dubbed George Bernard Shaw "a eunuch perpetually inflamed by flirtation," and found Queen Elizabeth's tragedy the fact that "the poor child spends her life asking questions which people answer!" In a 1960 letter, alas quoted only in a footnote, West offered Oscar Wilde's son the definitive word on his progenitor's fate: "What your father did to little boys is not so criminal as what little boys did to your father's prose."

West's letters also provide a melancholy picture of her personal life. As early as 1913, she told her lover H.G. Wells, "I always knew that you would hurt me to death some day, but I hoped to choose the time and place." Their son, Anthony West, proved an equally long-term torment, as he alternated between private complaints and public attacks. Though the constraints of career, motherhood, and Wells would have crippled a lesser being, West displayed remarkable fortitude and surprising modesty. She was ever ready to defend herself, debating such heavy hitters as Arthur Schlesinger and Lionel Trilling. Yet she refused to engage in self-promotion, and seldom even referred to her own work until it was a fait accompli. (A comical exception to the rule would be the author's fantasia about her novel The Judge: "Thomas Hardy makes his wife read it to him over and over again, it being the only book ever written as gloomy as his own. His wife told me this in accents of incredible bitterness.")

As she grew older, Rebecca West came to feel that society and even intellectuals perpetuated a climate of lies, treachery, and triviality, which she felt obliged to combat. How effective a battle this was is anybody's guess. Still, her letters afford us the whole woman--vital, passionate, and even, from time to time, mortifying. "Yours wildly," she signed one. Who would have her otherwise? --Kerry Fried

From Library Journal
Dame Rebecca West (1892-1983)--novelist, journalist, essayist, literary critic, travel writer, and political writer--wrote with vigor throughout her 90 years. In addition to these genres, West wrote several letters a day, an estimated 10,000 in her lifetime. Of those surviving, Scott (English, Univ. of Delaware) selected over 200 from family and library collections in the United States and Great Britain for this volume. Arranged chronologically, the letters reflect West's personality, political concerns (e.g., suffrage, communism, fascism, Fabian socialism, apartheid, and Cold War espionage), love affair with H.G. Wells, literary opinions and interpretations of contemporaries (e.g., George Bernard Shaw, Virginia Woolf, Ezra Pound, James Joyce, Emma Goldman, and Fanny Hurst), travels, and concerns with biographical works written by her son, Anthony West; Victoria Glendinning; and Gordon Ray. Scott provides succinct, informative introductions to each section of letters. This well-edited volume will help contribute to scholarship on West. Recommended for academic libraries.

Review
"A unique, exhilarating and disturbing torrent of letters by a unique, exhilarating and disturbing woman whose life and literary work spanned almost a century, and who was both the agent and the victim of social change. Forthright and controversial, her letters range over politics, literature, gossip, sex, friendship, and her own extraordinary experience of life." Victoria Glendinning "Rebecca West's letters are irresistible - a medley of insight and canny observation mixed with a touch of paranoia. This ably annotated volume portrays a brilliant, strong, and romantic woman in stormy literary, political, and romantic times." Arthur Schlesinger, Jr.

questionable attention to detail in the preface
By Clarissa A. P. West
Rebecca lived through a lot of interesting things and knew interesting people, so if you're looking to read her letters, this is probably a pretty good collection of nicely typed out copies of them. I would disregard the preface since the editor, Bonnie Scott, has obviously not spent the time on attention to details and solid background information. If you want to read about Rebecca, I would recommend "Rebecca West: a saga of the century" by Carl Rollyson, who spent many hours at our home talking with my father and getting all his facts right over a long period of research.

since my last review, I have written to Bonnie Scott and she has contacted the publishers to correct errors. So it's getting better.

Women in 19th-century French art were represented as victims of a harsh urban working-class life. This book offers the argument that this representation obscured the model woman of ideas, a prominent figure in the narratives of French national and sexual politics.

Mary Through the Centuries: Her Place in the History of Culture, by Professor Jaroslav Pelikan

The Virgin Mary has been an inspiration to more people than any other woman who ever lived. For Catholics, Protestants, Jews, and Muslims, for artists, musicians, and writers, and for women and men everywhere she has shown many faces and personified a variety of virtues. In this book, a scholar who is the author of numerous books - including the best-selling "Jesus Through the Centuries" - tells how Mary has been depicted and venerated through the ages. Jaroslav Pelikan examines the biblical portrait of Mary, analysing both the New and Old Testaments to see how the bits of information provided about her were expanded into a full-blown Mariology. He explores the view of Mary in late antiquity, where the differences between Mary, the mother of Christ, and Eve, the "mother of all living", provided positive and negative symbols of women. He discusses how the Eastern church commemorated Mary and how she was portrayed in the Holy Qur'an of Islam. He explains how the paradox of Mary as Virgin Mother shaped the paradoxical Catholic view of sexuality and how Reformation rejection of the worship of Mary allowed her to be a model of faith for Protestants. He considers also her role in political and social history. He analyses the place of Mary in literature - from Dante, Spenser, and Milton to Wordsworth, George Eliot, and Goethe - as well as in music and art, and he describes the miraculous apparitions of Mary that have been experienced by the common people. Was Mary human or divine? Should she be revered for her humility or her strength? What is her place in heaven? Whatever our answers to these questions, Mary remains a symbol of hope and solace, a woman, says Pelikan, for all seasons and all reasons.

Amazon.com Review
A sequel to Jesus Through the Centuries, this scholarly study of Christ's mother Mary by Jaroslav Pelikan, a Yale historian of Christian theology, is thoroughly grounded in formal theology yet still explores the many manifestations of Marian devotion that have emerged in the wider culture. These manifestations include images from art, music, and literature, from Mary's Immaculate Conception to her bodily Assumption into Heaven. Pelikan minutely researches the universal appeal of Mary in the Old Testament, New Testament, and even the Koran, finding clues to her identity everywhere from the Bride in the Song of Solomon to the Mexican image of The Virgin of Guadeloupe.

In his bibliographic note, Pelikan admits to spending more than four decades of impassioned authorship and scholarship on Marian studies. "It is," Pelikan notes, "impossible to understand the history of western spirituality and devotion without paying attention to the place of the Virgin Mary." Accordingly, he explores the persona of the Virgin Mary and her place in society, tracing the legends, scriptures (including the Koran), the early church fathers' writings and the evolving doctrines concerning her. Pelikan also includes views of Mary that have been expressed through poetry, hymns and the visual arts. This inclusive work covers it all, and in doing so helps explain the importance and attraction Mary has had over the centuries for various cultures and religions.

From Library Journal
As the distinguished Yale theologian and church historian observes, "The Virgin Mary has been more of an inspiration to more people than any other woman who ever lived" and "has been the subject of more thought and discussion of what it means to be a woman than any other woman in western history." Here, Pelikan traces what Mary has meant in different times and places.

A short history of Mariology
By Seth Aaron Lowry
Jaroslav Pelikan is one of the foremost scholars and authors who has written on the topics of early church history, development of tradition, and the history of Jesus. This book is actually a companion to his other book, "Jesus Through the Centuries", and attempts to understand why Mary has played such a prominent role in church theology, devotion, and tradition.
This question becomes even more perplexing when one realizes that Mary's role in the gospels is very limited, and she is only mentioned once by name outside of the gospels. Yet, this did not prove a hindrance to the early church fathers who went about scouring the pages of the Old Testament to find references to the mother of our Lord. The one technique that proved most useful to the fathers was reading the Old Testament allegorically instead of literally. By employing this method the fathers were able to find typologial similarities between Eve and Mary. Therefore, by the end of the 2nd century Irenaeus was able to develop the comparison between Eve and Mary, so that just as the apostle Paul saw Christ as a second Adam, Irenaeus viewed Mary as a second Eve. Pelikan argues that since Paul began the process of applying such an allegory from the Old Testament to Jesus that it was not a stretch for the fathers to make the connection between Mary and Eve.
The next step in the developing Mariological process was the application of the title, Theotokos, or the Mother of God. The need for such a title stemmed from the many Christological heresies that were appearing during this time. By calling Mary Theotokos the fathers were able to guarantee that Jesus' humanity was safeguarded, and also that his divinity was upheld. Nevertheless, Mary's new title as Theotokos only strengthened the growing devotion toward her. Pelikan shows that Athanasius, the great orthodox theologian, makes reference to a Marian celebration in his writings. In addition, in his writings against the Arians Athanasius argues against the position that Jesus was God's most perfect and best creation, but instead reserves that honor for Mary.
When Pelikan arrives at the period of medeval history, he shows how Marian devotion blossomed into a full blown phenomena. During this time Mary was showered with such titles as Mediatrix, Queen of Heaven, Mother of the faithful and many other such titles. In Bernard of Clairvaux, Mary had a great advocate who spoke very highly of the Mother of God. Yet when it came to one of the most pivotal doctrines of Catholic theology, that of the immaculate conception, Bernard and Aquinas denied that the doctrine was a reality. They believed that such a doctrine made Mary immune from needing a savior and made her wonderful qualities seem less special. It wasn't until Duns Scotus argued that the immaculate conception saved Mary more perfectly by preventing her fall rather than rescuing her from a fall, that the doctrine became common in the West.
Finally, Pelikan dives into the period of the Reformation and illustrates that although the Reformers eschewed much of Marian doctrine that developed in the middle ages, they did not in fact abandon everything. The Reformers maintained that Mary was indeed the Theotokos, defended her perpetual virginity, and some even held to her immaculate status. What the Reformers disagreed with were the practices of praying to Mary and the saints, and the view of Mary as a Mediatrix. The Reformers believed that the role of Mediator belonged to Jesus alone, and that all prayer addressed to Mary and the Saints was superfluous and useless.
In the last chapters of the book Pelikan examines the Marian dogmas that have been promulgated by the Catholic Church: the immaculate conception and the Assumption. Pelikan traces the developments of these doctrines all the way from the fathers of the early church to the present day theologians and church officials who have expressed these views. Lastly, Pelikan shows how the person of Mary is an important person to all Christians and that she is an example of faith that everyone should strive to emulate.

An Outstanding Presentation by a Great Scholar
By M. Ramos
This is one of the best works about Mary in recent years. Jaroslav Pelikan, an excellent scholar, gives an outstanding presentation about the place of the Virgin Mary in the history of culture. As he did with Jesus Through the Centuries, he uses his vast knowledge of history, theology and art to illustrate, in a fascinating and engaging way, the development of Marian theology and devotion. Pelikan goes in a chronological way, from the biblical tradition and the dogmatic and devotional definitions of the first centuries of the Church to the latest dogmatic definitions in Roman Catholic theology. The author also explores the view of Mary in the Islam, Eastern Orthodoxy and Protestantism. The book is both scholarly and readable, making it accessible to the scholar and the general reader.

Remembering your Mother
By A Customer
Professor Pelikan adapts the successful format which he developed for Jesus through the Centuries: . . . over a decade ago to explore various presentations of Mary and her role as expressed not only in popular piety and theological development but also in other cultural expressions particularly literature, painting, and, to some extent, music. He has designed 16 chapters, each with a distinctive title, painting, and theme all organized somewhat chronologically. In his introduction, Pelikan explains the timeliness of this study, citing diverse contemporary issues such as feminist scholarship, Marian apparitions and ecumenism. He devotes chapter 12 to Goethe's treatment of "the Eternal Feminine" in his Faust; and chapter 13 to the popularity of Marian apparitions since 1830. Pelikan's interest in ecumenism not only informs his treatment of Orthodox, Catholic, and Protestant views but motivates this whole collection. Moreover, he broadens ecumenism to look at Christian relations with Judaism particularly in the first two chapters and then in chapter 5 to include an extended treatment of the treatment of Mary in the Qur'an.
Throughout Pelikan describes various presentations of Mary lucidly, perceptively, and, occasionally, provocatively. Although several of the chapters were written for other contexts, most chapters do reflect a common method. Both the professional scholar and the informed university student will recognize Pelikan's reliance on documented primary texts. He usually refers the reader to one pertinent scholarly treatment of the issue at stake. After two chapters dealing with the relative lack of detailed information in the New Testament, Pelikan goes on to describe the appropriation of themes and allusions in the Hebrew Scriptures by a process of "creative amplification." To describe his own position on the development of doctrine, he appeals twice to the effective metaphor about a legend emerging like a pearl from a small irritant. One sign of this process is the exploitation of actual misreadings of the original language and in the manuscript traditions of the Latin Vulgate. He cites the issue of "parthenos" in Isaiah 7.14, the implications of the conjunction in Song of Songs 1.5 "I am black and beautiful" and the confusion at Genesis 3.15 over the gender of the pronoun. Unfortunately Pelikan does not apply his descriptive and textual skills to the apocryphal Protoevangelion of James which became a rich source of the legends and themes about Mary.
Pelikan demonstrates his knowledge of primary evidence in subsequent chapters. In chapters 10 and 12 he deals with Dante's Divine Comedy and Goethe's Faust. In chapter 5 he describes the Islamic treatment of Mary in the Qur'an with its respect for her simple obedience, perpetual virginity, and motherhood of Jesus as human.
Pelikan does relate specific themes of theological development to his approach. In Chapter 4 he deals briefly with the Theotokos mentioning the dispute at the Council of Ephesus in 431 but concentrating more on the antecedents of Cyril rather than on the crisis itself. This is surprising in view of the important difference with the Qur'an and the care he takes in chapter 11 to demonstrate the respect in Luther and in other reformers for Mary as Mother of God. Moreover the lack of a stronger focus on the Theotokos contributes to the omission of the significant Renaissance composition of the Madonna and Child. Instead most colored plates deal with the Annunciation and they should be incorporated within the discussion more effectively.
He does deal with a number of doctrinal issues such as his presentation of her status as second Eve, with a particularly appropriate illustration, in chapter 3. He treats Jerome's contribution to perpetual virginity and Ambrose's effort to accommodate a respect for the state of marriage in chapter 8, unfortunately without acknowledging some of the current scholarship in this sensitive area. In chapter 14, entitled "the Great Exception" he sketches the long history of the immaculate conception beginning with Carolingian monasticism, noting the reluctance of Bernard of Clairvaux and Thomas Aquinas, and culminating with the Papal declaration of 1854. He sums up the theological issue lucidly but some of the texts in this chapter remain unidentified.
This book demonstrates scholarship in the service of understanding diverse religious and cultural traditions. It will stimulate and at times provoke his peers; it will inform and always challenge the intelligent student.

Treasury of the Basel Cathedral, by Timothy B. Husband

The medieval Treasury of the Basel Minster miraculously survived earthquakes, wars, iconoclasm, and the Reformation, only to be dispersed in the early nineteenth century. More than half of its holdings are now in the Historisches Museum Basel, while the remainder are in museum collections all over the world. This book presents more than seventy-five of these splendid ecclesiastical and secular objects from the Basel Minster, dating from the early eleventh through the early sixteenth century, spanning the Early Romanesque period to the Reformation. Most of the works are of gold and silver - many encrusted with precious stones, antique gems, or translucent enamels - but there are also textiles and objects of hardstone, rock crystal, bronze, and wood, including the doors of the original storage cupboards. All are reproduced in full colour and comprehensively discussed. The four essays in the volume focus on the history of medieval Basel and on the function of cathedral treasuries, with particular emphasis on the Basel Treasury and its contents. This beautiful book is the catalogue for an exhibition of objects from the Treasury held at The Metropolitan Museum of Art from 28 February to 27 May 2001

Amazon.com Review
Basel, Switzerland, is one of the few European towns to have retained a substantial portion of its medieval treasury. When the Protestant Reformation reached the city in 1529, the costly ritual objects used on the high altar of the cathedral were locked away for protection and not seen for three centuries. Many were then auctioned off by the municipal government and the objects scattered in museums and private collections. For a hundred years attempts have been made to bring them back together, culminating in an exhibition at the Metropolitan Museum in New York for which Treasury of the Basel Cathedral is the catalog. A fascinating reconstruction shows how some 70 splendid ecclesiastical and secular objects made of gold and silver, crystal and precious stones would have been arranged in ritually significant positions on the altar. The types of object, the dates at which they entered the treasury, and alterations made to them in antiquity all provide valuable information about medieval life. For example, when the authority of the bishops was challenged after the earthquake of 1356, the number of gifts of reliquaries increased, the divine power invested in them protecting the power of the church. Treasury of Basel Cathedral is a sumptuous presentation and an intriguing story of scholarship, devotion, and detective work. --John Stevenson

From Publishers Weekly
When Americans began drafting a Bill of Rights suitable for their new republic, they were actually following longstanding Anglo-American tradition. In a well-researched, though hardly pathbreaking, history, Levy (Blasphemy, etc.), professor emeritus at the Claremont Graduate School, devotes chapters to important protections: freedom of speech, freedom of religion, habeas corpus, prohibitions on bills of attainder, etc. With each topic, he delves into its sourcesAEnglish common law, Enlightenment philosophy, colonial state constitutionsAably characterizing the social and historical forces that influenced the evolution of each right. It's an academic approach that's useful as history even if it solves few contemporary problems. Take, for example, Levy's discussion of the right to bear arms. When ratified, he notes, the Second Amendment created an individual rather than a collective right. But this settles the matter only if one believes that legal and constitutional history stopped in 1789. As recent constitutional theorists (e.g., Bruce Ackerman) have noted, law, including constitutional law, evolves, effectively undergoing amendment through a gradual consensus-building process involving courts, legislatures and the public. Indeed, Levy's own keen historical account illustrates how legal concepts have changed over time. His failure to confront or even acknowledge how this dynamism is at work in contemporary debates renders this book ultimately of only academic interest. (Sept.)

From Library Journal
Constitutional historian Levy, author of 36 books concerning American politics and constitutional issues (e.g., The Palladium of Justice: Origins of Trial by Jury), provides a systematic and comprehensive analysis of the origins of the Bill of Rights and other constitutional provisions that protect rights. His historical analysis frames fundamental principles of "liberty" and "rights" by interpreting each of the first nine amendments to the Constitution and demonstrating differences between 18th-century American ideals and English common-law practice. His informative arguments in this important work concern nature and the sources of the Bill of Rights within American democracy, providing understanding for both scholars and citizens. Levy's approach to these controversial values, which protect the rights of the people, will be the source of future legal and public discussion. A significant contribution to understanding the Bill of Rights; highly recommended.ASteven Puro, St. Louis Univ.

An excellent analysis by a leading constitutional historian
By Glenn H. Reynolds
This is a very well-written and informative guide to the history and development of the Bill of Rights by one of our leading constitutional historians. It is clearly written, and can easily be followed by non-lawyers and non-historians. Nonetheless, the analysis is sophisticated.
The two parts most likely to draw attention are Levy's treatment of the Second and Ninth amendments to the Constitution. With regard to the Second, Levy joins the overwhelming number of constitutional scholars and historians who believe the Second Amendment protects an individual right to arms. And he does so unequivocally: "Believing that the amendment does not authorize an individual's right to keep and bear arms is wrong. The right to bear arms is an individual right. . . . Moreover, the right to bear arms does not necessarily have a military connotation, because Pennsylvania, whose constitution of 1776 first used the phrase 'the right to bear arms,' did not even have a state militia." (pp. 134-35). Levy even criticizes Harvard professor Laurence Tribe for saying otherwise (136) -- though in fact Tribe has changed his position and now agrees with Levy. But this took place as Levy's book was in press. At any rate, revisionist writers such as Garry Wills will find little comfort in this book.
On the Ninth Amendment, Levy may annoy many who disagree with him about the Second (and vice versa). Levy argues that the Ninth Amendment was meant to protect both positive rights (e.g., voting, the presumption of innocence, etc.) and natural rights, which he identifies with the Declaration of Independence's "Life, Liberty and Pursuit of Happiness." He has little patience with those who claim otherwise: "To argue that the Framers had used natural rights as a means of escaping obligations of obedience to the king but did not use natural rights 'as a source for rules of decision' is hogwash. One has only to read the state recommendations for a bill of rights to know that the natural rights philosophy seized the minds of the Framers as it had the minds of the rebellious patriots of 1776. One can also read natural rights opinions by members of the early Supreme Court to arrive at the same conclusion." (p. 255). So much for the narrow originalist theories of, for example, Robert Bork.
That the book heaps scorn on the half-baked theories of Garry Wills and Robert Bork is just a bonus, though. In substance, it is strong. The writing style is graceful. And the coverage is remarkably complete for such a slim volume. Great work, indeed.

A Carefully Written History about Fragile Civil Liberties
By James E. Egolf
G.K. Chesterton wrote that if men do not learn history, they will lose their rights. Leonard Levy's book titled THE ORIGINS OF THE BILL OF RIGHTS justifies this remark, and this book gives a solid account of what should be important to Americans. Unfortunately, too many Americans do not know history and care little about their civil liberties. Yet, Levy' book is there for the record. Levy gives detailed background to civil liberties and explains that the Bill of Rights document was assure in early National U.S. History. THE ORIGINS OF THE BILL OF RIGHTS is a book that explains the modifications and enhancements of rights which are too often taken for granted or have been forgotten.

The Framers, as Levy calls them, did not include a Bill of Rights when they wrote the Constitution in the summer of 1787. Some of the Framers did not think they were necessary. Others argued that the state constitutions provided for civil liberties rendering a Bill of Rights unnecessary. However, the Anti-Federalists used the fact that because the U.S. Constitution did not have a Bill of Rights, that was reason not to ratify the document. The Federalists looked foolish when arguing that a Bill of Rights was unnecessary and quickly changed their views in support of the Bill of Rights. The political bargain was that a Bill of Rights would be proposed to be added to the U.S. Constutition, and ratificastion was based on this promise. The Anti-Federalists' complaint about a Bill of Rights is important. This reviewer wrote elsewhere that without the Anti-Federalists, there would be no Bill of Rights. Without a Bill of Rights, there would be no U.S. Constitution.

Levy begins the assertion of rights with the rights of Habeas Corpus and protection of Bills of Attainder. Habeas Corpus (to have the body or person) meant that one could not be detained indefinately without a formal charge of a specific criminal act. The Petition of Right (1628)provided this protection in an attempt to prevent English monarchs from arresting political opponents and dissenters and holding them without formal charges. This protection afforded those arrested a chance to inform a judge that charges were bogus, and defendants knew exactly what charges they faced. Therefore defendents and their attornies were able to mount a defense against the charges.

Bills of Attainder are forbidden in the U.S. Constitution. The English monarchs used Bills of Attainder to get death sentences against political opponents. A Bill of Attainder was a Parliamentary Act designed to punish someone without due process. Henry VIII got rid of Cromwell by this method.

Levy's book deals extensively with First Amendment Rights. At the time of ratification of the U.S. Constitution, most Americans were Protestant, and Protestants were given considerable religious freedom. Catholics found safe haven in Maryland, and aside from some Puritan excesses, there was almost complete religious freedom. Some colonial legislatures disestablished the Church of England. Unlike Europe, people could enter professions and businesses regardless of religious convictions. As an aside, the Pennsylvania colonists probably had the most religious freedom.

Other First Amendment Rights included Freedom of the Press and Speech. Blackstone's COMMENTARIES served as a guide which only provided that there should be no prior restainst. However, men could be charge for seditious libel for what was written and published. Criminal libel was enforced even after ratification of the Bill of Rights. Both the Federalists and Anti-Federalists, including Thomas Jefferson, used criminal libel laws against political opponents. But when the Alien and Sedition Acts were passed in 1798, there was vigorous protest against criminal libel. These criminal actions stopped between 1798-1800 when men argued that since the government was of the people, they could not libel themselves by dissent and criticism.

The Right to Keep and Bear Arms was part of English Law. Levy explains that this was in part to keep men ready for militia duty, and men could use arms to protect their homes and loved ones. Pennsylvania which did not have a militia, still allowed men to be armned. This right has been debated with the improvement and lethal effect of modern firearms.

Levy's examination of the Fourth and Fifth Amendments is interesting. Originall English authorities could use general warranst which violated privacy and security. Levy patiently explained that protest over Writs of Assistance used by British authorites gradually led to specific search and arrest warrants. This development was based on Chapter 39 of Magna Carta (1215) which Levy contends was misinterpretated.

Levy also explains that the Fourth Amendment overlaps the protection against self incrimination of the Fifth Amendment. If authorities had general warrants, they could use the abuse of search to incriminate men and women. Levy also gives a good explanation of the use of Grand Juries beginning with King Henry II (1154-1189). The problem of grand jurors is that they were used as trial jurors which tainted criminal cases. As early as 1352, the English separated grand juries from trial or petite juries. In other words, the due process clause of the Fifth Amendment and the mention of grand juries blended with Sixth Amendment Rights.

Trial by jury originally gave defendents the right to challenge prosecutors and their witnesses. Gradually, defendants could confront hositle witnesses and present witnesses and evidence on their behalf. The use of 12 jurors may have been based on the 12 Tribes of Isreal or the 12 Apostles of Christ.

Seventh Amendment Rights provided that Common Law Rules would apply to civil cases. Anti-Federalist opponents complained about this until Madison & co. included it in the Bill of Rights.

Eighth Amendment protections against excessive fines and cruel and unusal punishment are self explanatory. Flogging was not considered cruel, and the English used flogging on women as late as 1841. The death penalty was not considered cruel as long as the execution did not involve torture. Basically, this amendment was based on the premise that the punishment fit the crime.

Levy explains that the Ninth Amendment protection of unenumerate rights was dormant until 1965 when the U.S. Supreme Court struck down a Connecticut law that forbade family planning and contraception. Levy explains that Ninth Amendment rights are part of natural law and includes decisions of marriage, family life, careers, etc. This amendment tried to protect those rights that could be forseen in the late 18th century.

Leonard Levy wrote a comprehensive book re The Bill of Rights. He could have cited the Catholic Canon Law as a source of Natural Law. He is one of the few to suggest that Trial by Jury originated with the Catholic Council of Lyon in 1215. Yet this book is important for anyone who appreciates his or her civil liberties. Unfortunately, those who do care are few in number these days.

By Betty Sylva
